1 Fields of application and modification of terms and conditions of sale.

The terms and conditions of sale apply to any relationships between www.LaChocolatière.ch and any individual ordering an item on La Chocolatière’s website.

La Chocolatière is allowed at all times to modify the terms and conditions which will immediately apply to any new order.

When subscribing or ordering, the customer needs to confirm he is aware of and accept the terms and conditions. These apply to all orders from the customer. The possible special conditions mentioned on the website exploited by La Chocolatière in relation to the displayed products are part of the terms and conditions. In case of divergence between both, the special conditions prevail.

2 Order from clients

The client can order one or more displayed products, following the procedure and the ordering modalities provided by the website.

Once an order is placed following the rules of the website, this order consists of the client placing an offer to buy a product online following the purchasing conditions of the website.

For every order, the client must insert his/her email address to which all the information in relation to the order will be sent. It is the client’s responsibilities to keep this address updated and to know about the potential emails from La Chocolatière.

Any email sent from la Chocolatière on the client’s email address will be considered as received by the client the day after it has been sent. It is the client’s liability if there are transmission and sending issues.

The client has 24h after the order has been placed to inform La Chocolatière of a change of delivery address. However, this case will only be taken into account if the order has not been sent yet. If so, the client is responsible to find a way to receive the order at the address mentioned at the time of order.

3 Validation of orders – strict and non terminable orders

To place an order, the customer needs to be over 18 and not to be under guardianship. The client ensures that all the transmitted information are aligned with the reality and respond to any damages made to La Chocolatière if these information are false.

The order placed by the client follows the article 2 mentioned above and consists of un offer to purchase a product displayed and available on the website. Once the order is definitively confirmed by the client, it cannot be cancelled before receiving the order and without the acceptance or refusal of La Chocolatière.

La Chocolatière is allowed to accept or refuse any orders without mentioning the motives. La Chocolatière will communicate its decision via mail at the address mentioned by the client at the time of order.

4 Price

La Chocolatière has the right to modify its prices at all time, but has the obligation to display the prices at the time of order. The displayed prices are in Swiss Francs and include all taxes (TVA). The client will have to pay the delivery costs which will appear at the time of order.

The displayed prices are available only in Switzerland and Liechtenstein.

5 Advance payment and security

The client’s offer to purchase a product online implies un payment in advance of the price of the product and the charges related to the credit card.

The payment in advance is done on the bank servers that are available on the website. This means that the client’s bank information does not get out of La Chocolatière’s website. This payment is therefore 100% safe.

The order will be saved and validated once the payment chosen by the client has been accepted. His/ her order will automatically be validated and his/ her card debited the moment the order is saved.

The client needs to fill the subscription form displayed on the website before validating an order. The information of the client’s credit card or Postcard are protected thanks to the 3-D secure system from Saferpay. The card number is not sent to La Chocolatière.

The risk of an issue happening with the payment system is supported by the client.

6 Delivery modalities and delivery delays

The products are delivered at the address indicated by the client at the time of order. The client is liable if any damages happen to the package such as loss, destruction, once the package is transferred from La Chocolatière to the carrier. In case there are errors in the wording of the recipient’s delivery information, La Chocolatière is not held liable for any impossibility to deliver the package.

The costs related to a package being sent back to the shop and then back to the correct address is under the client’s responsibility. La Chocolatière can ask the client to fulfill the payment of the delivery cost before the package is sent again. In case the package is sent back to La Chocolatière because of an impossibility to deliver, the costs are always clearly displayed at the time of order.

All available products are generally sent in the next 1-2 working days. The delays mentioned are linked to treatment, preparation, and shipping.

In the case where La Chocolatière is incapable of delivering the package in the 15 days following the shipping, the client can cancel the order by mentioning the order’s reference via mail to La Chocolatière. This cancellation will be taken into account only if La Chocolatière receives the mail 24h before the package is back to the shop. If not, the order cannot be canceled anymore. The cancellation will have to reach the shop before a 20 days delay after the order has been placed.

In case of a valid cancellation, the client will fully be reimbursed for the advance payment. The client will not be able to ask for monetary compensation from La Chocolatière.

La Chocolatière has the right to cancel a delivery even if accepted, without having the obligation to mention the motives to the client. In that case the client will be refunded for the advance payment.

When receiving the package, the client has to fully and immediately inspect the package to detect any apparent defects such as packaging issues, missing products, etc.

7 Responsibilities

La Chocolatière will uniquely respond to direct damages that are proven by the client to have been cause by the company’s negligence or a contracted third party’s negligence.

La Chocolatière is responsible for the prices linked to the delivered products and for the service delivery. All further responsibilities are not on La Chocolatière. The client will not be compensated for damages not related to the product.

The choice and the purchase of a product or service are under the client’s responsibility. The total or partial impossibility to use the products cannot result in any compensation or refund from La Chocolatière.

In any case, a refund will always be limited to the price paid by the customer at the time of order.

8 Returns

If the product has a defect, the client must file a request of return under a 7 days’ delay after the shipping date.

Accessories

The return is possible only if the original product and packaging are not damaged and if the product is not working as it should. If we consider that the returned product has been used, we have the right to reject the request of return and to cancel the refund.

Packages

When multiple products are purchased at a bundled price, the right to return is only applicable on the bundle itself. If we consider that the returned product has been used, we have the right to reject the request of return and to cancel the refund.

Promotional offers

Any product sold through a promotion cannot be returned

Return process

To have the right to return a product and to start the process:

  • The client needs to file the request form, available at the bottom of the page on the website, in order to receive an RMA (Return Merchandise Authorization) code. Without it the return cannot be accepted. If the return is not made within 5 days after receiving this code, the return will not be accepted.

The risks and costs of delivery are under the client’s responsibility.

After receiving the package and inspection, a confirmation email will be sent to the client to inform him/ her of the reception of the return with an acceptance or refusal of the request.

Reimbursement

Once the return validated, La Chocolatière’s obligations are limited:

  • To a refund under the form of a gift voucher

Exchanges

Unfortunately, we are not doing exchanges for the moment.

9 Client’s obligations

The customer is advised to use the product following the shop’s instructions as well as following the maintenance recommended by the shop to ensure its proper functioning.

10 Data protection

By subscribing on the website, the client accepts receiving ads or else from La Chocolatière. The client can unsubscribe safely and without any costs by following the procedure on the website.

La Chocolatière transfers personal information to third partie if and only if these parties are necessary for the completion of an order.

La Chocolatière has the right to analyse collected data and to anonymously use these information about purchasing behavior for commercial purposes.

La Chocolatière has the right to delete a subscribed client without have the need to justify its decision, without letting the client know and without letting the client prevent it. This would happen in the case where a client does not conform to the terms and conditions.

The subscribed clients that have been excluded are not allowed to subscribe again under their name or another without La Chocolatière’s consent.

12 Applicable law and place of jurisdiction

This contract and the sales organized by La Chocolatière are under the Swiss law. In case of litigation, the place of jurisdiction is Lausanne exclusively.
